What is mediation?
Mediation is a non-adversarial process for resolving disputes. It is an alternative to going to trial, and is particularly useful if the parties to the dispute want to carry on a relationship in the future. An impartial person, called the mediator, assists the parties in identifying common goals and interests. With the identification of common interests or concerns, the parties can begin to find areas in which they can come together.
What are the advantages of mediation?
The parties involved make the decisions and not a judge or other third party. This process is more cost-effective than going to trial. It is also less emotional stress on the parties involved, as mediation is grounds for compromise.
What kinds of cases is mediation most used for?
Mediation has become quite common in resolving domestic relations disputes (divorce, child custody, visitation) and is often ordered by the judge in such cases. Mediation has become more frequent in contract and civil damage cases as well.
